I bought a new construction home about 2 years ago. The company I purchased from owns the adjacent lot and just started development on it this week. A surveyor came and notified me that the back of the shared fence is about 2 feet into the neighbor’s (very tiny) lot. The fence starts in the correct position in the middle of the property line, but slants out into their property at the back. I pulled my survey from when we purchased, and it shows the same thing, so we’re all on the same page here.
Is there any chance I’m financially liable if they want to relocate the fence to the shared property line? I have no issue with giving up that tiny section of yard (that isn’t really mine), but am hoping that relocating a fence that is technically not on my property is not my cost burden.
