Hello everyone, I’m new here because a weird situation is unfolding.

    I was at discount tire, it’s a tire change shop for those who don’t know in the Midwest.

    I was parked, and an employee who just finished working on another car was driving it to park it… but he hit my car instead.

    He got out and I didn’t see you or the car. I have dash cam proving the truth.

    I’ve opened a claim with their so called, “self insured” which turned out to be Fleet Response. It’s been three weeks and they’re not paying for anything. They keep telling me to go through my insurance, AAA. But my deductible is $2,000. And there could be damages unseen.

    I told my agent I don’t want AAA to pay and for them to pay. At this point it’s become such a headache. I depend on my car to earn because I drive uber. If a car is damaged uber closes the account.

    Can I legally go to my courthouse and sue them for not taking responsibility and keeping me in this wait for no reason. As stated, they’ve viewed the footage and said they are responsible. But they will not proceed any further. They don’t answer, email back, or text back.

    At this point, I wanted opinions from anyone who has knowledge. My agent seems incompetent as well.

    Do I sue them? What do I do? I don’t have $2,000 to pay my insurance especially since it was the employee of Discount Tire at fault.

      You can take them to small claims court but the easiest option is to use your own collision. You chose a $2,000 deductible and that’s the risk of having such a high deductible. Any carrier that covers company’s is going to be slow with the claims process. It’s a crummy situation but this is exactly what your insurance is for. They can subrogate the other carrier to ideally get your deductible back in the future.

    2. Do you have full coverage? Does your insurance company know you are a gig worker? (Uber) Reach out to your insurance & they will handle it.
