Hello, I have a minor child who has a significant disability. He receives in-home supportive services (a service linked to Medicaid.) This year, we had a caseworker who attempted to remove the service without cause. We filed an appeal, and we had to spend a significant amount on an attorney. We won the case, and the services resumed, but we are out 15K in attorneys fees. I think the 15K should be a deductible medical expense, but everything I'm reading online says it is not.
Has anyone ever come across a situation like this? I'd love to be able to deduct that 15K. Since his disability is a medical condition and this is a service he needs because he has a disability…. Is there any leeway?
Another avenue to explore is a deduction for childcare / dependent care… IHSS provides him supervision, so would the fee to retain an attorney to keep the supervision be deductible as a childcare/ dependent care expense?
