Hi guys looking for help with this OT credit for my wife who is and OR RNFA nurse.
So her pay is quite difficult to understand.
Her base rate is -$60/hr for 40 hours.
She is required to take call shifts. She takes 3-6 additional mandatory shifts per week, which are all paid $5/hr when not on premises and 1.5x plus differential when on premise.
Now some call shifts are actual OT and some are not depending on when in the week she has them.
My thought is that all of her call shifts should be the full credit and not 1/2 portion of the OT credit as that is her is contracted pay rate.
Where with regular OT, it’s her pay plus the 1/2/hr.
Super difficult to breakdown.
Also depending where and what position she’s working it could be up to $10/hr differential per shift so each paycheck is like 30 line items

Only FLSA mandated overtime premium counts for the deduction.
I was reading up on the on call FLSA rules a bit back and if I remember correctly on call but free to do as you please off premise isn’t mandated for overtime. That seems to be collaborated by the fact that she isn’t paid time and a half for that on call time.
From the info presented so far the overtime that is not paid at time and a half isn’t eligible overtime at all, no portion of it, for the deduction.
