I am seeking guidance on how to appeal the denial of my tax return, which occurred because my ex fraudulently claimed our daughter as a dependent. Although our court order does not designate which parent may claim her, we share 50/50 custody and applicable tie-breaker rules apply. I have documentation, including a possession calendar, showing that I had more overnights.

    1. Paper file the return. The irs will reach out to both of you with more information. Might be best to include a statement that you are paper filing to claim your daughter as meet the tiebreaker rules.

      OP,

      Do you mean that you attempted to efile a tax return and the efile submission was rejected because Mom had already filed her return claiming your daughter?

      If that is the case, then file on paper. Include a statement re: eligibility and your documentation (a copy of it anyway, don’t send anything without keeping copies for yourself).

      Another option besides filing on paper is to get yourself an IP PIN from the IRS. That should allow you to efile even with the conflicting dependent.
