I was rear-ended, and the other party’s insurance company has been unable to contact their insured. Even though I’ve uploaded a lot of photos as evidence, they said they are preparing to deny my claim because they cannot reach their policyholder.

    I have already filed a DOT accident report myself. Should I contact my own insurance company? I only have liability coverage.

    1. It depends on your state whether inability to contact an insured is grounds for denial of a claim. In some jurisdictions there must be willful and avowed obstruction in order to deny the claim by a third party.

    2. Unless the other insurance denies *coverage*, not liability, there’s nothing your insurance can do here. And then only if you have uninsured motorist property damage coverage.

      Otherwise, you can sue the other driver in small claims and maybe that’ll get them to cooperate with their insurance.
