Yesterday, a person in a large box truck making a delivery hit my car parked on the street while I was away from home. It was a public street, my apartment does not have parking.
He tried to leave the scene, but my neighbor stopped him and got my husband.
I arrived about 30 mins later, the man did not want to provide his insurance or driver's license. He wanted to work it out outside of insurance. I said I was happy to work something out, but would need his insurance and DL as collateral.
After some arguing he finally provided his information and left. I got a quote from a mechanic that was really high (5k). Although, I think the mechanic was being honest, there was extensive fiberglass damage and the driver's side door is wrecked and they don't make parts for my car anymore (2004 Ford Thunderbird) I sent him the quote and said, I think this is high let's work something out. And he threatened to sue me (???).
The complicated part is, I was about to sell my car. Had a buyer lined up and canceled my insurance. I know this was dumb on my part, but here we are! My registration is also incomplete. It is PAID but hasn't passed smog yet.
The driver is under company policy and registered with the DOT. It's his company and he is the only employee from what I can tell online.
Honestly I just wanted to negotiate with him so that I can make a little bit of money and junk my car now that I can no longer sell it. It is not worth the money to fix it and sell it.
But now, he is being so insane, I feel like I should pursue filing a claim with his insurance. I looked at filing a police report online but in my city you have to report in person for this particular circumstance (if it was hit and run I could do it online, but not when I have his info).
I am pretty certain an insurance company would determine my car totaled and I think that is fine. I just don't know what to do next.
– Will I be in trouble because I am uninsured?
– Will I be in trouble because my registration is paid but incomplete?
– Is it possible to file a claim with the at fault's driver's insurance myself?
– How likely is this to work in my favor?

While it may sound contrary, do not file a police report. It might be better to avoid the commercial driver’s insurer, as there is a likelihood it may be used against you. If you to converse with insurance,e, make your registration issues the centerpiece of the conversation.
What state are you in? There are a handful of states that have no pay, no play laws for property damage.
Generally, you can file a claim with the at fault party’s insurance. But there are a few states that would bar you from any recovery b/c you were uninsured.
I’m curious if it’ll be covered since technically your car wasn’t allowed on the roadway at all with its status. Hoping for the best!
In some states you would be out of luck. Some have No Pay, No Play laws where if you are uninsured you cannot collect from the other person.
There are 51 jurisdictions for insurance and what happens in one state is totally different in the next one.
It was written all over this. You don’t have a car lined up to sell and then cancel insurance before it’s sold. You didn’t even have a smog check.
He owes you the lesser amount of either a total car or the repairs
But honestly, my feeling is I don’t think you should give a dime because you didn’t have insurance. Your car shouldn’t have been on the road anywhere
I don’t understand why you can’t file a claim against his insurance. I’ve been hit before and I’m not at fault and I only called my insurance company to notified them. They didn’t even make a note of it. They said just let us know if you needhelp my insurance company.
