I am from Texas(at-fault state) but had a car accident in Minnesota(which is a no-fault state). I am confused because I have been told to file a claim with my insurance(from MN police). However, when I called my insurance, they stated that most people claim the other driver’s insurance and not their own(due to potential rate increases). I am just very confused on what I should be doing. I have already started a claim with the other driver’s insurance but am confused if I should do mines as well.

    Edit: I am also going to see a provider for some injuries after the accident. I don’t know if that changes anything

    1. Minnesota No Fault laws, like most other No Fault states, apply only to injuries, not property damage. I believe that MN law requires that your TX coverage automatically comply with mandatory coverage (like going through your own carrier for injuries) for accidents that happen there. So your TX policy should provide the coverage for your treatment, provided you don’t exceed that limit. If you do, you can sue the MN driver in MN court for your injuries.

      If you weren’t at fault for the accident, your damage should be paid for by MN, but they won’t pay you to fly back and forth if your car is being fixed in MN.

      You may need a higher level adjuster for this, so don’t be afraid to push past the front line folks that don’t have the experience.
