I got into a minor car accident when I was 23, in winter of 2024. I found out a little over a month ago that despite my insurance being very close to a settlement with the plaintiff, they decided to not settle last minute and have filed a civil lawsuit for negligence and pain and suffering against me for some minor injuries that their doctor has contested, but they insist on getting treated. My mom is on my car title as she signed with me when I bought it several years ago, but we have since had a falling out and do not talk. I talked to the lawyer my insurance hired me today, and he advised giving my mom a heads up that she could possibly be named as a codefendant. I have not lived with her in over 4 years and have had my separate car insurance from her for the last 4 years as well. Because she was not a joint policyholder with me, she was not informed of the claim or anything when the accident happened.

    My lawyer is beginning the discovery phrase and is trying to access medical documents and says that it’s very possible we could settle soon if that goes smoothly. Is it likely she is going to be named and served as a codefendant, or only if this litigation ends up going to trial? Like I said, I haven’t talked to her in years. If she is named, how does it work? Would my lawyer represent her as well, or would she need her own lawyer through her insurance, and how would that work when she never filed a claim?

    I would appreciate any guidance.

      if your mom has some assets worth going after expect the other driver’s lawyer to include her in a lawsuit.

      It’s a simple matter to look up the court filing and see if she is listed as a defendant. You can do it. You’ve seen the lawsuit. You know what court it’s in. Just look it up on the court’s website.
