Question about appeal likelihood in Massachusetts. I was sitting at a light in the right hand lane two cars back from the light, when the light changed the left lane was empty and I switched lanes, about two cars back another driver switched lanes and accelerated into the intersection. I slowed in the intersection because the lanes merge ahead and traffic was slowing, she honked, slammed on her brakes and swerved left hitting my driver rear bumper with the passenger front of her car. She claims I pulled out in front of her without enough room and "brake checked her". The officer that wrote up the incident marked it that I had changed lanes preceding the accident, then wrote out what she said and only included that I said I slowed because of traffic ahead not that I was fully in my lane before the accident. I was determined at fault by my insurance. But there are no witnesses or other video evidence and the damage pattern is consistent with either account so it seemed odd to me that I was determined at fault. I was going to appeal this but what are the odds that it actually gets reversed?

This one sounds like a toss up to me. Probably worth the effort. Note that it won’t change your insurance company’s handling of the liability claim that the other driver might present. It only affects underwriting.
