EDIT: since everyone seems inclined to advise an attorney. I don’t have one. I don’t want one. I have family who’s an attorney that I’ve bee consulting. I’ve handled this claim for two years without an attorney and I don’t want one now. I know what I want for settlement. And the current offer is close. I am asking because I am curious.
I will not be paying an attorney 33% of my settlement at this point. I would lose money.
If you’re going to suggest consulting with an attorney- move on along to another post. Thanks!
I was in a head on collision in May 2024, two years ago! Other driver 100% at fault, both cars were totaled. It was a rough one.
I’ve been obtaining continuous care for whiplash and neck soft tissue damage.
I’ve had so much PT, chiro, PRP injections, dry nettling, shock wave, etc. and nothing has worked. It’s ongoing and flares up with daily activity.
My care plan now includes a cervical nerve ablation since less invasive therapies haven’t been successful.
(And a steroid injection for my elbow because I have nerve issues down into my elbow and hand).
However, I have to settle in 2 years in my state or go to litigation. I’d like to settle and 2 years is nearly quickly.
Numbers are:
Total medical billed to date: $27,091.98
Future medical care plan cost: $10,400
Missed wages: $2,720.25
Total economic damages: $40,320
All throughly documented!!
Soft tissue injuries are hard! What would a fair settlement be for economic and non economic damages that include my scheduled future care?
