Hi all.

    My girlfriend and I are considering renting a home that comes with a pool in SoCal. Maybe I’m paranoid, but I’m nervous of potential liability exposure for the pool itself and would appreciate some expert insights.

    1. If someone were to get injured due to the pool, would that fall on the tenants’ renters insurance or the homeowners’ insurance? If the tenant is the one at risk, what level of insurance coverage would be adequate to minimize exposure?

    2. If the pool somehow causes any sort of property damage to the rental property or any neighboring property, how would that be handled by insurance?

    Feel free to tell me I’m just being paranoid if these issues aren’t worth worrying about.

    1. 1 – Depends on what happens. Could be the tenant, could be the homeowner, might even be both. You would want to have liability coverage to at least cover your assets, but pool injuries tend to be more on the moderate to severe side.

      2 – If the pool is part of the property then it would not cover damage under the liability portion for coverage, it would be under the first party coverage with the deductible applying. If they determined it was a covered loss. As far as neighboring parties, that would depend if it was something that was caused by negligence and covered.
