So my car got into an accident and someone insured with Progressive backed into my car.
I am a third party claimant
Now my car is at the repair shop, Progressive is forcing a rental car to me through enterprise only.
However I said I will claim loss of use as a third party claimant I have the right to loss of use.
However Progressive is pressuring only rental car not compensation for loss of use even at their negotiated rate which they give to enterprise, while the car is in the repair shop.
The state is NJ
Can anyone shed light on this or if anyone has experience.

That sounds frustrating. My understanding is you may still have a valid loss-of-use argument as a third-party claimant, but the part that matters is state law and whether Progressive can satisfy that by offering you a comparable rental. In a lot of cases, loss of use is tied to the reasonable rental value of a similar vehicle, so the fight is usually over whether their offer is actually reasonable, not just whether they prefer Enterprise.
