Hi,

    I am a Tennessee policyholder with a State Farm auto policy, including Coverage Symbol U1 (UMPD).

    I was recently rear-ended while stopped at at a red light and the driver fled without providing insurance information. Their temporary plate did not match the car, so it was possibly even a stolen car. I have a Police report, though I imagine they have better things to do than try to figure out who hit me.

    My car sustained some minor damage, but needs repairs. State Farm claims that in TN UMPD only applies if my vehicle was parked/unoccupied when hit by an uninsured driver, so they are putting this claim through as Collision (no fault) with my higher collision deductible.

    However I can't find any wording in my policy, nor any TN statute, that implies UMPD only applies if my vehicle was parked or unoccupied when hit.

    Anyone have any experience and can comment?

      Push back. Insist on submitting through UMPD unless they can provide policy language requiring otherwise. You should be good as long as you reported the incident to police timely.
