I was rear ended by a police officer a few days ago probably around 25mph. I have a rear dash cam and it shows he made no attempts to brake. Impact felt pretty big and I’m not sure how much damage my car has behind the bumper yet. I’ve contacted my insurance but have yet to complete the insurance claim as I’m still waiting for the police report, which contains information of the police officer and accident. It takes up to 10 days for the department to process reports. I’m going to the doc next week to get checked out as I do have a stiff neck and some back pain when turning a certain way. This is my first time involved in something like this, but should I find a lawyer or try to resolve through insurance?

      Also keep in mind that there are short deadlines to file pre-litigation claims against government agencies.  They vary by state.

      I was hit by a sheriff’s deputy several years ago , the deputy ran through a red light and was found to be at fault. Dealing with the county was a special kind of pain in the ass…. My recommendation would be to get a consultation with an attorney, don’t wait for the police report, especially since you may have injuries

    3. Happened to me 25 years ago, rear ended by a cruiser while I was sitting at a red light.

      “Whoops, I missed the brake pedal” is what he said.

      He told me the police insurance came from their budget, and to take the car to the shop of my choice and tell the shop to bill the police department.

      So that’s what I did. Didn’t cost me a thing. I didn’t even talk to my insurance about it.

      But I also wasn’t hit hard enough to be physically hurt.

      Go through your insurance and wait to be refunded your deductible, or wait for the police department claims administrators to finish their investigation, which can be very time-consuming. If you have video of the accident, send it to your adjuster. Utilize your rights to consult with an attorney and to seek medical care if you think it’s necessary. Ask your adjuster what the state requirements are. In Florida, you have 14 days to seek treatment – most people start with urgent care or primary care doctor.
