I really apologize if this is the wrong subreddit and/or flair, please correct me if so. I’ve had a question about a scenario involving my married parents & grandparents since discussion, clarity, etc., amongst my family is basically nonexistent and I can’t find anything on this kind of situation specifically. I live in GA in the USA. My parents sold their home to my older sibling and moved into a home 12 years ago that was solely owned by my grandmother. 2ish years ago, my grandmother signed over half of ownership to my dad. My mother has no property in her name at the moment. She has always feared that she could be left in a very bad situation if anything unexpectedly happened to my father at any point due to her and my grandmother’s dynamic. My parents are happily married and would not divorce. However, my grandmother has an extremely manipulative/controlling force over my dad (and family in general) that has caused issues in the past. I just want to know if there’s something legally concrete that could make her unable to even inherit his half if anything happened?? Or if her inheritance of said property could be super problematic/stressful or threaten her comfort due to her and my grandmother’s personal relationship??

      This is fully dependant on if this is joint tenancy with rights of survivorship or tenants in common.

      Joint Tenancy with Rights of Survivorship is the last man standing gets to keep the property. If dad died, your brother gets all the house, since he’s the other owner.

      Tenants in Common is more standard, and the half owned house passes on through inheritance as usual.

      Joint Tenancy is usually reserved for business deals, but if Grandma was a controlling person, she may have done this to retain control over what was going on.
