I was driving in the middle lane on a 3 lane road. A police car was parked on the right lane with someone pulled over.

I slowed down to about 25 km/h and stayed in the middle lane while passing the police car. To be completely honest, I did not know that I'm required to move over into the left lane. I was under the impression that slowing down and giving a wide berth was sufficient.

I ended up getting a $400 ticket for this… I honestly don't care about paying the ticket, I'm just concerned that this is going to do damage to my insurance premium.

Note: I've been driving for about 9 years now and have never had incident.

Please give me your opinion on whether you think it's worth it to fight this ticket.

My defense would likely be that the traffic code states you must move over *IF SAFE*, but this occurred right before an intersection and I could not have been sure if the lane change was safe – there may have been other cars. (Although I'm not entirely sure if it was dangerous as I did not check the left lane)

You can try to get a moving violation amended to a non moving violation assuming this is something you can do in your area. Insurance premiums do not change with non moving violations.

    2. Pretty frustrating, given you clearly made an effort to follow the spirit of the law

    3. Fight this, I wouldn’t have moved out of a middle lane for a stopped vehicle with a full lane between us… I would move to the middle lane from the right lane… Don’t let asshole cops cost you $400.
