I'm not sure if there's anything I can do, but I'm pretty sure I'm just screwed and it's frustrating.

I'm from Idaho which is an at fault state if it helps.

Wife was in an accident Wednesday. Other party was at fault and uninsured. We only have liability because the car is 17 years old and the hope was that others would have insurance if they caused the accident. Before the flood of people moving here, I think I could have actually trusted that. Sadly, the massive influx has caused a lot of issues of which, uninsured drivers appear to be on the rise.

Another issue is that the PD is short handed. They replaced dispatch with a useless AI system which says to file a report online in case of an accident. Website only has a place for a hit and run or an accident under $1500 in damages. Neither fit. My wife called me unsure what to do. I finally managed to run the AI around long enough that dispatch called me back. She said an officer would call. He called my wife and told her, file the report online and just use the under $1500 because the site hasn't yet been updated.

Thought perhaps they would then do something about it. Like to give the lady a ticket at least. Nope. Because they had us file it where we did, it immediately closed our the report. We went in person to talk about it and they printed a report to send our insurance but won't do anything else. Lovely. Thought really, not sure it matters. Other person is uninsured. She told my wife they were on the verge of being homeless already (may or may not be true).

Got an estimate of damages yesterday. Over $8k. Car is worth between $5-7k. Insurance likely would have totaled it. But there isn't any.

Talked to our agent. She said file a claim with them anyway and persue in small claims. Thing is, I can't see how filing a claim with our insurance would help anything. They sure aren't going to cover any of it and, if anything, could possibly raise our rates (which is ridiculous since we haven't had an accident or even a ticket in years).

As others have pointed out, going after the other person in small claims is unlikely to produce results. Sure they would be told, pay these people x money. And then they would just move on with life. I'm not an agency that can sing them for lack of payment and if they're already struggling financially, they wouldn't care anyway.

So are we just screwed? Try to sell the car as a parts car and go find something else? It's incredibly frustrating that the uninsured party just gets to walk away without consequences. Even the damage to their own car was minimal compared to ours.

You’re hoping for a fix you didn’t pay for.

Sue the motorist who caused the crash or call it a loss

Let me get this straight? You don’t have insurance because you expected other people to carry it? And all these “people coming to the state” don’t carry insurance. But you don’t either?

And now you want a solution without paying for it?

      Entitlement, much?

You can try to sue them, but you can’t punish people that have nothing. They aren’t going to prison for this.

If damage to their car was minimal, can you sue for their vehicle. Then you can drive their vehicle or sell it.
