Hi all, looking for some advice.

    My car was parked in front of my house near USC this afternoon when it got hit. The damage is on my car , and the other driver’s car has damage on the front right side.

    The issue is that there are no clear surveillance cameras nearby—only a streetlight that might have a camera, but I’m not sure if it actually records.

    I did talk to the other driver at the scene and recorded our conversation. In the recording, he admitted that he hit my parked car while I wasn’t moving and agreed to use his insurance to cover the damage.

    Police haven’t arrived yet.

    My questions:

    Will his insurance still cover my damages based on this situation?

    If he later changes his story and denies fault, how useful is my recording?

    Should I go through my own insurance right away or wait?

    Any advice on what steps I should take next would be really appreciated. Thanks!

      He doesn’t get to decide if he’s at fault. His insurance will decide that. But it’s gonna be hard to deny liability when your car was parked. There could be coverage issues or a policy limits issue that could prevent you from receiving full compensation for your damages or any compensation at all. Since their investigation could take a few days or even a few weeks, if speed of repairs is of great importance to you, then use your own collision coverage if you have it. Your insurer will subrogate to try to get your deductible back.

      If he lies to his insurance or even just doesn’t pick up the phone when they call to verify your claim it could result in significant delays. There could be any number of coverage issues. How bad are the damages? California property liability minimums are 15k so that could cause its own issues. If you have the flexibility of allowing a few days to see how it plays out and *really* don’t want to pay your deductible out of pocket you can attempt to claim with the at fault insurance. But there are a lot of potentially headache inducing variables.
