I got rear ended in Massachusetts by a grandson driving his grandfather’s car that is registered in Washington state. Both cars are totaled. My insurance is good, but I may need to sue their carriers for my rental car. Near as I can tell the grandfather had PEMCO, which is WA only carrier, and the kid had Progressive (maybe a non-owner policy?). Both carriers gave me claim numbers. Progressive accepted liability, seeming to mean the kid. PEMCO called back a day later and said they are not covering anything and are closing the claim, possibly because the car had been garaged in Massachusetts for a while without their knowledge? I thought primary insurance is the one attached to the vehicle. Is it possible they had two policies on the car at the same time? Who’s on the hook here for subrogation and for remunerating my rental?? Thanks!

      Your carrier will try to pursue the owner and driver personally. If successful, you’ll get your deductible back. If you need a rental, you should always have that coverage on your policy for situations like this. I wouldn’t hold your breath on getting your deductible back or rental reimbursed from someone without proper insurance.
