Location is Texas.
Situation is essentially the title. I loaned a friend of mine my vehicle after theirs had been stolen, and we agreed he would carry his own full coverage in case anything were to happen.
At the time of the accident, both of us had active policies for the same vehicle. He didn’t survive the accident. I reached out to both insurance companies and his stated to let mine deal with the problem as in the registered owner. Now my insurance is about to pay out the total loss and stating the amount will count as a claim paid out to me. Shouldn’t they try to recoup the money from the other company and therefore not have it count as a claim against me?
This is the last thing I want to be dealing with as we haven’t even had the funeral, but it’s still a logistics problem that needs to be sorted out.
Friend borrowing vehicle carried their own insurance. They got in an accident and my insurance is holding the claim against me.

Oh my god. I don’t know the answer here, and it might even be worth checking with a lawyer in your area, but I couldn’t leave the post without saying I’m so sorry you are going through this. What a nightmare. And your poor friend…
Insurance follows the vehicle. I’d say sorry for you loss but you seem otherwise.
