Despite what result might be in XRP's judgement by the court it still will not prevent it from being used by the BANKING SECTOR as it is already deemed to meet the requirements of FinCEN as Virtua Currency. Ripple could potentially register XRP as a Commodity or Security. This is a long game and personal involved have every right to do so to keep themselves in the loop. To me what's wrong with the whole case is measuring the possibility that XRP is a security using the Howey test. There is an Axium of law which states that, "The Law is Specific. " Way back when the Howey test was devised, there wasn't even personal computers let alone crypto currency, so how the hell can Howey apply? If we really want to be correct here, the laws for this asset class are yet to be written.
