Well, Ethereum does pass the Howey test which means it's an unregistered security. Which means it will be in trouble with the SEC, Gensler or no Gensler. The reason BTW that Gensler is refusing to state this clearly in those hearings is that the SEC's case against ETH is in an advanced preparations stage and he (correctly) thinks it would be wrong to comment at this moment. Be it as it may, not a financial advice here, but stay away from ETH, it most likely won't be pretty.
