Couple of questions.

    I have a new revenue stream starting 5/1 that will finally put me firmly above the “worth it” line for an S-Corp.

    My initial research shows that there’s a 75 day window to file for the start of the year, there’s an extension, too.

    My first question is, can I still form an S-Corp this late in the year and make it retroactive to Jan 1st?

    Second, I am in TX. I have an LLC that is currently suspended due to not filing annual reports. If I can indeed form an S-Corp now, can I resurrect that LLC, file to elect S Corp Structure, and then form the S-Corp effective Jan 1st? I’m not opposed to forming a new LLC to avoid the headache but that means another $400.
