I previously worked for an American MNC in India, where I was granted ESPP in an E-Trade account. After moving to the U.S. for higher education (currently on an F-1 visa), I sold these , which were considered Indian income. The proceeds from the sale were transferred directly into my U.S. bank account.
I’m confused about where I should pay capital gains tax. Since the ESPP were earned while I was in India, does that mean the tax liability remains in India? Or do I need to pay taxes in the U.S. because I’ve been living here for 1.5 years? Additionally, how does my F-1 visa status and residency for tax purposes impact this?
How do I determine where the tax is owed, and is there a way to avoid double taxation? I’ve already received the proceeds in my U.S. account but want to ensure compliance in both countries.
If anyone has dealt with a similar situation or has expertise in cross-border tax rules, your guidance would be immensely helpful!
