Hello all, a family member of mine rolled over a previous employer’s 401k to a personal IRA earlier this year with the intent of it being a direct rollover.

    They accidentally marked themselves as a nonresident alien, causing the financial institution to send a 1042-S instead of a 1099-R and the rollover being a taxable event.

    The family member in question has been a permanent resident for over 25 years thus it should be treated as non-taxable event. We contacted the financial institution and requested they send the correct 1099-R form but they refused.

    How should we go about fixing this? We got a tax filing extension until October of this year.
