I own a DJ company in New York (New York City) that wants to offer photo booth services (with attendant) at weddings. I am trying to figure out what I have to charge sales tax on.
It is not the type of booth that you sit inside. It is a kiosk with an employee operating it, taking photos of people and handing them prints after the photo is taken. See here.
I have heard that you have to charge sales tax on tangible items like photo booth prints. This leads me to two questions:
- The photo booth costs $1,500. Could I advertise it as $1,300 for the photo booth and $200 for the prints? And then just charge sales tax on the $200?
- If I have "digital" photo booths that don't print, do I have to charge sales tax on those?
I have an accountant and he isn't sure. He doesn't really seem to know about it.
Is there any New York accountant or lawyer on here who knows the answer definitively? Or does anyone know one?
