    Basically, over a decade ago, my stepbrother’s bio mom would claim my stepbrother on her taxes despite living with my family. She did this for many years. Just to note, bio mom lives in a different state. There is physical proof that my stepbrother did not have residency at his bio mom’s (school transcripts, court documents, and such). Could my mother sue my stepbrothers bio mom for anything? And if my mom can’t do anything, should the IRS still be informed of the fraud??

    Is there a possible case for my mother if she sues my stepbrothers bio mom for false dependency claims on taxes??

      Your mother doesn’t have standing to do anything here. Stepson’s mom isn’t in any way obligated to pay whatever credits the IRS would have given her or her stepson’s mom 10 years ago.

      Your mother filed her taxes and didn’t claim your stepbrother as a dependent. During that time, if she had a dispute was the time to pursue this. The IRS will only issue refunds for 2023, 2024 and 2025 at this point. Anything before that cannot be claimed.

      The IRS isn’t going to pursue fraud against a parent claiming their own child 10 years ago.
