Gensler did a go around with the NY AG filing a securities lawsuit on ETH. Gensler knew damn well to have a 3rd party do this, keep it in court for a few years to sort the bank involvement guidelines to get regulated. Question, why is ETH or ADA staking not a security? I am not a lawyer, however no clear answers yet

If you pass the howey test then you are a security. you have it wrong. Also most of the POS blockchains had an ICO in the U.S. and Cardano did not.
